I sent a messege to the ncs asking if they knew if the next firmware for the dsi is being developed and when it might come out if they knew. the reply back was an ad for the dsi xl "Hi, I am glad you contacted us. Nintendo recently announced a new, larger version of the Nintendo DSi which will be called the Nintendo DSi XL here in the Americas. It is expected for release in the first quarter of this year. Here’s some of what we know:
It has a 93% larger screen than the current DS Lite with a better viewing angle.
It comes with an additional, longer touch screen stylus.
Some Nintendo DSiWare software will come pre-installed on the system. At this time we don’t have specific details on an exact release date, available colors, or price. How funny. I've contacted Customer Service at least 5 times a year (usually by phone, winkwink) and I have never gotten this. I even got a free Gamecube from them. I don't exactly call them useless

As For The Topic: NOA failure? Most undeniably. What they always do? Not so much. It's a weird thing when it comes to customer service. Some companies higher strange English-speaking impersonators that live in foreign countries, some use people who barely know anything about the company who hired them, and some just don't even try.

Honestly, I'd be willing to bet such information (release dates) is considered classified information, and thus even if they do know, customer service isn't able to reveal any details unless the marketing or PR department decides to.

Ya it just seems to me like they skimmed over the letter not actually reading it and sent you that pre-written resposne. Don;t expect much from customer service as far as that kind of stuff goes.
